A BILL FOR AN ACT

 

 

relating to geologists.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

“Chapter

geologists

     §   -1  Definitions.  As used in this chapter:

     "Department" means the department of commerce and consumer affairs.

     "Director" means the director of commerce and consumer affairs.

     "Geologist" means a person engaged in the practice of geology.

     "Geology" means the science that studies the earth in general, including the investigation of the earth's crust and the rocks and other materials which compose it and the applied science of using knowledge of the earth and its constituent rocks, minerals, liquids, gases, and other materials.

     §   -2  Registration as professional geologist.  The director, upon application on a form prescribed by the director and upon the payment of the application and registration fees adopted by the director by rule, shall issue a certificate of registration as a geologist to any person who submits to the director proof of certification as a professional geologist by the American Institute of Professional Geologists.

     §   ‑3  Seal.  Each geologist registered under this chapter, upon registration, may obtain a seal of a design authorized by the director bearing the registrant's name, number of the registrant's certificate, and the legend "registered geologist".

     §   -4  Registry of geologists.  The department shall maintain a current list of all geologists registered under this chapter.

     §   ‑5  Rules.  The director may adopt rules pursuant to chapter 91 to carry out this chapter to provide for expiration, renewal, and replacement of certificates of registration and to otherwise carry out this chapter.

     SECTION 2.  This Act shall take effect on January 1, 2008.
