A BILL FOR AN ACT


 

 

relating to public housing.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 356D, Hawaii Revised Statutes, is amended by adding a new section to Part II to be appropriately designated and to read as follows:

     "§356D-____  Federal low-income housing rentals; income eligibility requirements.  (a)  The authority shall establish rules providing criteria for reexamining, at least once every twelve months, a tenant's annual income, assets, family composition, and any other relevant criteria to determine a tenant's rent and eligibility for continued occupancy.

     (b)  A tenant found ineligible for continued occupancy must vacate the dwelling unit within ninety days of the date of ineligibility unless otherwise provided by federal law.

     (c)  The rules may allow the asset and income limits to have a higher ceiling than the asset and income limits for the tenant's initial admission to a project and shall be regularly reviewed and adjusted for inflation."

     SECTION 2.  New statutory material is underscored.


     SECTION 3.  This Act shall take effect upon its approval.
