A BILL FOR AN ACT

 

 

relating to invasive species.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 150A, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§150A-A  Inspection, quarantine, and eradication service charge.  (a)  The department shall prescribe a schedule of service fees and charges and collect appropriate service fees or charges for pest inspection, quarantine, and eradication services from any person who imports any article, container, or packing material as described in section 150A-5, or means of conveyance.  The department shall establish a schedule of service fees and charges to ensure that the service is commensurate with the costs of inspection, quarantine, and eradication services.

     (b)  If an importer of commercial shipments subject to the service fees or charges under this section fails to pay the service fee or charge when due, the department shall assess a late payment penalty.

     (c)  The service fees, charges, and penalties collected by the department under this section shall be deposited into the pest inspection, quarantine, and eradication fund.

     §150A-B  Pest inspection, quarantine, and eradication fund.  (a)  There is established in the state treasury the pest inspection, quarantine, and eradication fund, into which shall be deposited:

     (1)  Legislative appropriations for inspection and quarantine services;

     (2)  Service fees, charges, and penalties collected under section 150A-A;

     (3)  Federal funds received for pest inspection, quarantine, and eradication programs;

     (4)  All interest earned on accrued moneys deposited in the pest inspection and quarantine treatment services fund;

     (5)  Grants and gifts; and

     (6)  Any other moneys made available to the pest inspection and quarantine treatment services fund from any other sources.

     (b)  The moneys in the pest inspection, quarantine, and eradication fund shall be used by the department for the operation of inspection and monitoring programs, related facilities, and the execution of emergency remedial measures when pests are detected in the course of inspection and quarantine activities by the department."

     SECTION 2.  There is appropriated out of the pest inspection, quarantine, and eradication fund the sum of $          or so much thereof as may be necessary for fiscal year 2007-2008 for the operation or inspection and monitoring programs, related facilities, and the execution of emergency remedial measures when pests are detected in the course of inspection and quarantine activities.

     The sum appropriated shall be expended by the department of agriculture for the purposes of section 150A-B, Hawaii Revised Statutes.

     SECTION 3.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2020.
