A BILL FOR AN ACT
RELATING TO GENETICALLY MODIFIED FISH.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 328, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§328-_ _ Genetically modified fish and fish products; labeling; identification. (a) No genetically modified fish or genetically modified fish product may be sold in the State in a packaged or unpackaged form if the packaged or unpackaged fish or fish product is not conspicuously labeled to identify the genetically modified fish or fish product.
(b) For the purposes of this section, unless the context requires otherwise:
"Genetically modified fish" means a finfish, shellfish, or either of its progeny whose genetic structure has been altered at the molecular level by means that are not possible under natural conditions or processes, including recombinant deoxyribonucleic acid or ribonucleic acid techniques, cell fusion, gene deletion or doubling, introduction of exogenous genetic material, alteration of the position of a gene, or similar procedure.
"Genetically modified fish product" means a fish product prepared from a genetically modified fish."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
