A BILL FOR AN ACT

relating to fireworks.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-  Fireworks; county regulation. (a)  Notwithstanding any other law to the contrary, the county legislative body of each respective county, by ordinance, shall determine whether, and the extent to which, each county shall regulate the sale, use, and storage of fireworks."

     SECTION 2.  Chapter 132D, Hawaii Revised Statutes, is repealed.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2008.
