A BILL FOR AN ACT


 

 

relating to mutual benefit societies.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 432, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§432:1-      Reimbursement for providers of health services.  (a) Notwithstanding any provision of any individual or group hospital or medical service plan contract, whenever the contract of a mutual benefit society provides for payment for any service performed by a participating provider of health care services, the provider of the service shall be entitled to payment at a rate of not less than one hundred and twenty per cent of the national average cost of the service, as determined by the United States Department of Labor, Bureau of Labor Statistics.  The rate shall be adjusted no later than fourteen days after the Bureau of Labor Statistics releases such data to the public.

(b) The department of commerce and consumer affairs shall adopt rules under chapter 91 as necessary for the purposes of this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on January 1, 2008.
