A BILL FOR AN ACT


 

 

proposing an amendment to Article x of the constitution of the hawaii state constitution.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Article X of the Constitution of the State of Hawaii is amended by adding a new section to be designated and to read as follows:

                   "LOCAL GOVERNANCE

    Section   .  Should a county, by resolution directed to the governor, determine it is in the county's best interest to have locally elected boards of education govern public education within their county or districts within their county, legislation effecting such a change in education governance shall be submitted to the legislature no later than the year following receipt of the resolution."

    SECTION 2.  The question to be printed on the ballot shall be as follows:

    "Shall a county be allowed to decide, by resolution directed to the governor, whether the county would like public education within their borders to be controlled by a locally elected school board?" 

     SECTION 3.  New constitutional material is underscored.

     SECTION 4.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
