A BILL FOR AN ACT


 

 

relating to fuel.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 486H, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§486H-A  Provision of gasoline not containing ethanol.  

(a)  Each refiner, as that term is defined in section 486J-1, shall make available to its company-operated stations, company-owned stations, or retailer who purchases gasoline from the refiner, whether through a jobber, directly from the refiner, or otherwise, gasoline that does not contain the ethanol content required by section 486J-10, subject to the following conditions:

          (1)  gasoline that does not contain the ethanol                     content required by section 486J-10 shall be                   distributed to at least one of the above-                      referenced type of stations in an area                             corresponding to a representative district;

          (2)  in the case of a representative district that                  spans different islands, gasoline that does not                    contain the ethanol content required by section                    486J-10 shall be distributed to at least one of                    the above-referenced type of stations on each of                   the islands within the representative district;                    and

          (3)  the station cannot be one that provides non-                        ethanol gasoline as of the publication of the                  report required by Act 130, Session Laws of                        Hawaii 2007."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on January 1, 2009.
