A BILL FOR AN ACT

relating to health products.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  Chapter 328, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§328-__ Labeling of health products. (a) Notwithstanding section 328-15, all health products offered for sale in this State shall display proof of certification from a reputable certifying authority of that product's safety and efficacy for its intended or advertised use.

For the purposes of this section, "health product" means any nonprescription device for which the manufacturer or seller makes the claim that the device is designed to treat, mitigate, or cure a physical ailment.

(b)  The director shall adopt rules in accordance with chapter 91 for the purposes of this section."

SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
