A BILL FOR AN ACT


 

 

relating to public access to coastal areas.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 115, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§115-    Public access to shorelines.  Notwithstanding any law to the contrary, the State shall provide public access to the shoreline.  To the extent practicable, the distance between each access under this section shall not exceed one-quarter mile."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $       or so much thereof as may be necessary for fiscal year 2008-2009 for the acquisition of public rights-of-way pursuant to section 1 of this Act.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  New statutory material is underscored.


     SECTION 4.  This Act shall take effect upon its approval; provided that section 2 shall take effect on July 1, 2008.
