A BILL FOR AN ACT


 

 

relating to beaches.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that as part of our State's culture and heritage, beaches and coastal areas are so important that the public trust doctrine guarantees every citizen access to and along our State's shoreline.  Beaches provide enjoyment and ocean access, and they are also the backbone of our State's visitor economy.

     The purpose of this Act is to protect and conserve our beaches, as well as improve lateral access to those beaches, for the benefit of present and future generations.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2008-2009 for the department of land and natural resources to:

(1)  Study and implement innovative beach management practices to support the long-term goal of beach and coastal preservation and restoration; and

(2)  Fund the costs of planning and constructing a walking trail along Maui's coastline.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2008.
