A BILL FOR AN ACT
relating to the alternative energy.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 342D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§342D- Alternative energy generation required. The director shall not approve or issue permits for the construction of any new wastewater treatment works with design flows equal to or greater than one hundred thousand gallons per day that is not fitted with a process for using the methane gas or other by-product of the sewage, sludge, effluent, or wastewater processed in the treatment works to generate energy to power the treatment works or supply electricity to the electric grid."
SECTION 2. Section 46-20, Hawaii Revised Statutes, is amended to read as follows:
"[[]§46-20[]]
Regulation of sewerage and wastewater treatment systems. Effective
July 1, 1987, counties may implement programs for the regulation of
sewerage and wastewater treatment systems in their respective county
jurisdictions; except that a county program shall be implemented by that county
immediately upon receipt of state funds pursuant to section 27-21.6(5). Each
county is authorized to adopt ordinances and rules on the design, construction,
and operation of sewerage and treatment systems and shall submit to the
director of health, for approval, a full and complete description of the
program it proposes to establish and administer under county laws[.];
provided that after December 31, 2008, county ordinances and rules shall not allow
for the approval of applications for the construction of a wastewater treatment
system or works with design flows equal to or greater than one hundred thousand
gallons per day, unless the treatment system or works is fitted with a process
for using the methane gas or other by-product of the sewage, sludge, effluent,
or wastewater processed in the treatment system or works to generate energy to
power the treatment system or works or supply electricity to the electric grid.
As used in this section, "treatment works" has the same meaning as defined in section 342D-1."
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval and shall apply to any applications for the construction of a new wastewater treatment system or works submitted for approval after December 31, 2008.
