A BILL FOR AN ACT


 

 

RELATING TO PUBLIC HOUSING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 356D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§356D-     Household member; divorce.  (a)  Notwithstanding any other law to the contrary, the authority shall not terminate the tenancy because of the divorce, annulment, or legal separation of a tenant who meets the provisions of subsection (b) upon the divorce, annulment, or legal separation of the tenant.

     (b)  Upon divorce, annulment, or legal separation, a tenant seeking to remain in the public housing project or complex shall provide the authority with a certified copy of a divorce or annulment decree or legal separation agreement that designates the tenant as entitled to remain in the public housing project or complex.

     (c)  The authority shall adopt rules pursuant to chapter 91 as necessary to implement this section."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
