A BILL FOR AN ACT


 

 

RELATING TO TOWING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§291C-    Towing companies.  All towing companies operating in the State shall require each of their tow trucks to display in plain view and in large bold legible print within the cab of each truck, the license number of the truck and the towing company's name and telephone number."

     SECTION 2.  Section 46-20.5, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§46-20.5[]]  Regulation of towing operations.  Any law to the contrary notwithstanding, the council of any county may adopt and provide for the enforcement of ordinances regulating towing operations, including but not limited to ordinances relating to rates, equipment standards, hours of operation, storage and safeguarding of towed vehicles, records retention and inspection, insurance requirements, vehicle operator requirements, and tax clearances; provided that [an]:

     (1)  The regulation shall include an ordinance requiring all towing operations in the county to display in each of the cabs of their tow trucks, in plain view and in large bold legible print, the license number of the truck and the towing operation's name and telephone number; and

     (2)  An ordinance shall not be effective to the extent that it is inconsistent with any law or department of health rule governing solid waste salvage facilities."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
