A BILL FOR AN ACT


 

 

relating to shopping carts.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

 


     SECTION 1.  The legislature finds that grocery shopping carts are often found strewn about neighborhoods.  This blights and pollutes the environment, and encourages the use of these carts for personal storage on public property.

     The city and county of Honolulu's procedures for refuse collection do not include the removal and disposal of grocery shopping carts.  To resolve the problem, it has become necessary to provide legislation enabling the county to remove and dispose of these carts.

     The purpose of this Act is to clean-up abandoned shopping carts from our neighborhoods by:

(1)  Allowing the refuse division of any county with a population greater than five hundred thousand to confiscate abandoned shopping carts; and

(2)  Authorizing the county to impose a $50 pick-up fee or a $100 recycling fee.

     SECTION 2.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-      Disposal of abandoned shopping carts.  (a)  Any shopping cart that appears to be abandoned, whether or not it contains any goods or other material, may be confiscated by the solid waste disposal division of any county with a population greater than five hundred thousand.

     (b)  A county that confiscates shopping carts pursuant to this section:

(1)  Shall allow a shopping cart owner to repossess the shopping cart within forty-five days of the date of confiscation, and may impose on the owner a repossession fee of $50 per cart; and

(2)  May dispose of shopping carts that are not repossessed within forty-five days of the date of confiscation, at a recycling center, and impose on the owner a recycling fee of $100 per cart.

(c)  All fees collected by a county under this section shall be considered revenues of the solid waste disposal division of the county."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
