A BILL FOR AN ACT

RELATING TO WATER RESOURCES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  There is appropriated out of the general revenues of the State of Hawaii the sum of $3,750,000 or so much thereof as may be necessary for fiscal year 2008-2009 for the planning and design of a reservoir to serve the agricultural and residential needs of the upcountry region of the county of Maui with a capacity of at least 300,000,000 gallons of water; provided that no funds shall be made available under this Act unless:

     (1)  The federal and county governments provide matching funds in an amount not less than $          ;

     (2)  The county of Maui has entered into a memorandum of agreement with the department of agriculture requiring that the water from the reservoir shall be provided for agricultural uses as well as residential uses; and

     (3)  Prior to the commencement of water service from the reservoir, the county of Maui consults with the department of the agriculture to determine the proportion of water that will be provided for agricultural purposes.

     The sum appropriated shall be expended by the county of Maui for the purposes of this Act.

     SECTION 2.  This Act shall take effect upon approval.
