A BILL FOR AN ACT

relating to consumer fireworks.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  The purpose of this Act is to impose a total ban on consumer fireworks except for religious or cultural purposes.

     SECTION 2.  Chapter 132D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§132D-   Use of fireworks restricted. Notwithstanding any other law to the contrary, it shall be unlawful for any person to set off, ignite, discharge, or otherwise explode consumer fireworks in the State at any time, except for religious or cultural purposes as allowed by county permit."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
