A BILL FOR AN ACT


 

 

relating to a kakaako makai parking structure.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the construction of a centralized parking structure in the makai area of Kakaako in the city and county of Honolulu with debt service payable from general funds is in the public interest.  Such a structure would reduce to some extent the design and cost burden for the developers of facilities at the John A. Burns School of Medicine and Cancer Research Center sites by allowing developers to transfer some of their parking space requirements from on-site at their Kakaako properties to the centralized parking structure.

     Similarly, consolidation of parking stalls would make construction more economical for private developers of Kakaako makai lands, who also contribute toward the cost of the parking structure.  Further, reducing the required number of on-site parking stalls would allow public and private developers to make more efficient use of their respective land and apply more aesthetic designs.

     The legislature further finds that the resulting centralized parking structure would provide much needed parking in the area and be easily accessible by the customers, patients, and employees of Kakaako makai public and private development projects.

     The legislature also finds that it is logical and justifiable to make a direct appropriation to the Hawaii community development authority rather than assess contributions from the John A. Burns School of Medicine or the Cancer Research Center of Hawaii, which are both under the jurisdiction of the University of Hawaii.  Because the capital improvement funding for the centralized parking facility will ultimately be borne by Hawaii taxpayers, the same source of revenue will be used to construct the structure, whether the appropriation is made directly to the Hawaii community development authority or to the University of Hawaii.

     The legislature directs the Hawaii community development authority to consult with the department of accounting and general services in planning for the construction of the parking structure because, at the conclusion of the planning phase, the responsibility for the design, construction, operation, and maintenance of the parking structure may be transferred to the department of accounting and general services.  The legislature also finds that the department of accounting and general services' extensive expertise and experience in the public parking field would be helpful to the Hawaii community development authority.

     The purpose of this Act is to authorize the issuance of general obligation bonds and make an appropriation for planning the construction of a central parking structure in the makai area of Kakaako in the city and county of Honolulu.

     SECTION 2.  The director of finance is authorized to issue general obligation bonds in the sum of $        or so much thereof as may be necessary and the same sum, or so much thereof as may be necessary is appropriated for fiscal year 2008-2009 for the purpose of planning a centralized parking structure in the makai area of Kakaako in the city and county of Honolulu.

The sum appropriated shall be expended by the Hawaii community development authority for the purposes of this Act.

     SECTION 3.  The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2010, shall lapse as of that date.

     SECTION 4.  This Act shall take effect on July 1, 2008.
