Description:

Directs the office of planning to prepare and file petition with the land use commission to reclassify TMK: 3-9-10:46 and 3-9-10:47, at Honolulu, Hawaii, from the urban district to the conservation district.  Directs the City and County of Honolulu to not issue any permits allowing the development of the parcel pending the final disposition of the petition.

A BILL FOR AN ACT


 

 

relating to land.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the open space on the Ka Iwi Coast is the last remaining open area in East Honolulu.  Citizens of the Hawaii Kai community have expressed their overwhelming desire to see this land preserved and protected.

     The legislature also finds that the open space at Mau'uwai and Queen's Rise is identified on the tax maps of the state as TMK: 3-9-10:46 and 3-9-10:47, respectively.  The land is presently classified by the state as urban and zoned by the City and County of Honolulu as P-2 General Preservation District.  Under that state land use designation and present county zoning, this open space is threatened with possible development of low intensity residential use.  The purpose of this Act is to arrest any development of these lands by directing the office of planning to prepare and file a petition with the state land use commission to reclassify the land into the conservation district.

     SECTION 2.  The office of planning shall prepare and file a petition, as soon as practicable, with the land use commission for the reclassification of TMK: 3-9-10:46 and 3-9-10:47, situated in Honolulu, Hawaii, from the urban district to the conservation district.

     SECTION 3.  Pending the preparation, filing, and final disposition of the land use petition required by section 2 of this Act, the City of Honolulu is directed not to issue any land use, subdivision, building, or other permit that will allow the development of  TMK: 3-9-10:46 and 3-9-10:47 for any purpose other than the continued use of the land as open space.

     SECTION 4.  This Act shall take effect upon its approval.
