A BILL FOR AN ACT


 

 

relating to land use.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 205, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§205-    Nonagricultural development contiguous to agricultural district.  (a)  The reclassification of any land that is contiguous to the agricultural district into the urban district or the rural district shall contain a condition that no nonagricultural development shall be permitted within three hundred feet of the property line bordering any parcel in the agricultural district on which farming operations are being conducted.

     (b)  For the purposes of this section:

     "Farming operations" shall have the same meaning as in section 165-2.

     "Nonagricultural development" means any development of real property for residential, commercial, or industrial purposes or the development of any infrastructure intended to serve residential, commercial, or industrial development."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, proceedings that were begun, improvements completed, or operations begun, before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
