A BILL FOR AN ACT
relating to county fees.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Cruise ship passengers; direct county services to passengers; county service fee. (a) Any law to the contrary notwithstanding, a county may impose a service fee on the owner of a cruise ship if:
(1) The cruise ship is berthed in waters of the county within a harbor, at a pier, or otherwise docked in the county; and
(2) A passenger of the cruise ship, while in the county, receives direct services from the county from entities or personnel employed by the county using county resources relating to but not limited to the following:
(A) Emergency medical services or other health services or assistance;
(B) Disaster rescue services or assistance of any sort, including from fire, water, evacuation, or other hazard;
(C) Police response or other county law enforcement services or assistance; or
(D) Any other lawful services, as determined by the county council, directly provided to a passenger by the county.
(b) The county shall transmit to the cruise ship owner a written notice of the service fee imposed no later than three days after delivery of the direct services to the cruise ship passenger. The cruise ship owner shall pay to the county the service fee imposed no later than one hundred twenty days after receipt of the notice of the fee."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
