A BILL FOR AN ACT


 

 

RELATING TO RECREATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Aloha Stadium is a public asset, but one that requires substantial expenditures to address a backlog of repair and maintenance problems.  In 2005, the department of accounting and general services contracted for a planning study for Aloha Stadium.  The final report, published in December 2005, included findings and recommendations related to a conditional survey, structural safety, capital improvements, stadium enhancements, and new stadium options.

     The legislature further finds that while it is critical to maximize the use and the income of Aloha Stadium, it may not be in the best long-term interests of the public to maintain the current stadium in perpetuity.

     The purpose of this Act is to require the University of Hawaii, with the assistance of other public and private sector entities involved in the development of west Oahu, to study the feasibility of constructing a new recreational stadium in west Oahu.

     SECTION 2.  (a)  The University of Hawaii, with the assistance of other public and private sector entities involved in the development of west Oahu, shall study the feasibility of constructing a new recreational stadium in west Oahu, including but not limited to an assessment of the:

     (1)  Optimal focus of a new recreational stadium, and whether the facility should be dedicated principally to sports and athletics;

     (2)  Possible sites located in or near regional growth centers in the west Oahu region, including land availability and infrastructure requirements for each site;

     (3)  Funding and development options, including existing and new public-private partnerships relating to mass transit and higher education campus development; and

     (4)  Alternative uses for the current Aloha Stadium facility and site, as a means of providing financing, or a portion of the financing for the new recreational stadium.

     The University of Hawaii may consult with federal and county agencies responsible for the mass transit planning for the region, the United States military, the Kalaeloa community development district, the department of Hawaiian home lands, and private sector organizations and entities involved in the development of west Oahu, as appropriate.

     (b)  In conducting the feasibility study, the University of Hawaii shall consider and update as necessary the findings and recommendations of the December 2005 Aloha Stadium Planning Study Final Report.

     (c)  The University of Hawaii shall submit the findings and recommendations to the legislature no later than twenty days prior to the convening of the regular session of 2009.

     SECTION 3.  There is appropriated out of the stadium special fund the sum of $           or so much thereof as may be necessary for fiscal year 2008-2009 for a feasibility study of constructing a new recreational stadium in west Oahu; provided that the University of Hawaii shall provide in-kind or other resources, as appropriate, to conduct the study.

     The sum appropriated shall be expended by the University of Hawaii for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2020; provided that section 3 shall take effect July 1, 2008.
