A BILL FOR AN ACT


 

 

RELATING TO MOTOR VEHICLE INSURANCE RATE FILINGS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 431, article 10C, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§431:10C-     Premium reductions for older insureds completing accident prevention course.  (a)  Any schedule of rates or rating plan for motor vehicle insurance submitted to or filed with the commissioner shall provide for an appropriate reduction in premium charges, except for underinsured motorist coverage, for those insureds who are sixty-five years of age and older, upon the successful completion of a motor vehicle accident prevention course meeting the criteria of the department of transportation with a minimum of eight hours, or additional hours as determined by rule of the department of transportation.  An eight-hour program-learning self-instruction course shall be made available in areas in which a classroom course meeting the criteria of this section is not offered.  The classroom course may be conducted by a public or private agency approved by the department of transportation.  The self-instruction course shall be conducted by an agency approved by the department of transportation to conduct classroom courses under this section.

     (b)  All insurance companies writing motor vehicle insurance in this State shall allow an appropriate reduction in premium charges, except for underinsured motorist coverage, to all eligible persons under subsection (a).

     (c)  Upon successfully completing the approved course, each participant shall be issued, by the course's sponsoring agency, a certificate that shall be the basis of qualification for the discount on insurance.

     (d)  Each participant shall take an approved course upon the renewal of the applicant's driver's license in order to be eligible for a continued reduction in insurance premium charges."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2008-2009 for the development of criteria for a motor vehicle accident prevention course.

     The sum appropriated shall be expended by the department of transportation for the purposes of this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
