A BILL FOR AN ACT
relating to children.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 571, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§571- Juvenile justice information system; mental health services. Notwithstanding any law to the contrary, when a child is reasonably believed to be subject to the jurisdiction of the court under section 571-11(1) or (2), the court or other designated agency, including a police officer, shall:
(1) Review the juvenile justice information system under chapter 846D for any record of offenses, detentions, dispositions, rehabilitation programs, or other events pertaining to the child; and
(2) Consider the information obtained under paragraph (1) when determining whether:
(A) The child is a first-time offender; and
(B) Mental health services for the child are appropriate under section 571-31.2, 571-31.3, 571-31.4, 571-31.5, 571-31.6, or 571-48."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
