A BILL FOR AN ACT
RELATING TO THE NATURAL ENERGY LABORATORY OF HAWAII AUTHORITY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that it is necessary at times for the natural energy laboratory of Hawaii authority to expend funds to market and promote its various projects and research. The legislature further finds that these promotional efforts and expenditures must be made quickly, or else a beneficial opportunity may be lost. This process can be slowed by requirements that the executive director seek prior approval before making expenditures for these purposes. The legislature finds that the executive director requires access to a small discretionary account from which marketing and promotional expenditures may be quickly made.
The purpose of this Act is to create a protocol account to be used at the discretion of the executive director of the natural energy laboratory of Hawaii authority for the purposes of marketing and promotion.
SECTION 2. Section 227D-5, Hawaii Revised Statutes, is amended to read as follows:
"§227D-5 Special fund. (a)
There is established in the state treasury a fund to be known as the
natural energy laboratory of Hawaii authority special fund, into which shall be
deposited all moneys and fees from tenants or other users of the authority's
parks, projects, other leased facilities, and other services and publications
as well as any grants or gifts received by the authority. All moneys in the
fund are appropriated for the purposes of and shall be expended by the
authority for the operation, maintenance, and management of its parks,
projects, facilities, services, and publications[,] and for the design
and construction of new facilities and the renovation of or addition to
existing facilities.
(b) Within the fund there is created a separate protocol account in an amount not to exceed $10,000, to be used at the discretion of the executive director of the authority for the purposes of marketing and promoting projects, research, development, or other activities of the authority; provided that the funds in the account may be expended by the executive director for these purposes without prior approval of any other state officer or entity."
SECTION 3. The director of finance shall establish a separate protocol account within the natural energy laboratory of Hawaii authority special fund pursuant to section 227D-5(b), Hawaii Revised Statutes, and shall transfer to the protocol account the sum of $10,000 to be used by the executive director of the natural energy laboratory of Hawaii authority for the purposes of this Act.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
