Description:

Changes the classification of the offense of promoting intoxicating liquor to a minor from a misdemeanor to a petty misdemeanor.  Allows the courts to impose a jail sentence for those convicted of the offense.

A BILL FOR AN ACT


 

 

relating to intoxicating liquor.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 712-1250.5, Hawaii Revised Statutes, is amended by amending subsection (4) to read as follows:

     "(4)  Promoting intoxicating liquor to a person under the age of twenty-one is a petty misdemeanor.  Any person convicted of violating this section may be sentenced as follows:

     (a)  For a first conviction, the person may serve a minimum term of imprisonment of no fewer than ten days;

     (b)  For a second conviction within five years, the person may serve a term of imprisonment of no fewer than twenty days; and

     (c)  For a third or subsequent conviction within five years, the person may serve a term of imprisonment of no fewer than thirty days."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
