A BILL FOR AN ACT
RELATING TO THE DEPARTMENT OF PUBLIC SAFETY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that section 353-32, Hawaii Revised Statutes (HRS), authorizes the department of public safety to "receive, use, manage, and invest moneys or property, real, personal, or mixed, which may be given, bequeathed, devised, or in any other manner provided from sources other than the legislature or the federal government, for any purpose...." Section 353-32, HRS, also authorizes the director of finance to deposit a gift of money "in a separate account in the state treasury and [expend it] in accordance with law and any terms and conditions that may pertain to the gift." The legislature further finds and declares that it was not the legislature's intent to authorize the department of public safety to establish a gifts to the department of public safety trust fund under section 353-32, HRS, or any other statute.
The purpose of this Act is to direct the department of public safety to close the gifts to the department of public safety trust fund, which was established by the department of public safety under the erroneous assumption that the establishment of the trust fund was statutorily authorized under section 353-32, HRS.
SECTION 2. The department of public safety shall close the gifts to the department of public safety trust fund upon the effective date of this Act.
SECTION 3. This Act shall take effect on July 1, 2008.
