A BILL FOR AN ACT
RELATING TO MOTOR VEHICLES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 249-6, Hawaii Revised Statutes, is amended to read as follows:
"§249-6 [Exemptions for certain
cars furnished to disabled veterans. Passenger cars owned by
persons who, by reason of their service disability, have been furnished such
cars by the federal government and have been so certified by the veterans
administration, shall be exempted from the tax herein provided for. This
exemption shall not extend to vehicles used for commercial purposes, nor to
more than one vehicle of any disabled veteran.] Exemptions for
disabled veterans, prisoners of war, members of the Hawaii National Guard and
Congressional Medal of Honor recipients. (a) Passenger
cars owned by persons who are disabled veterans, have been prisoners of war,
are qualified members of the Hawaii National Guard or Congressional Medal of
Honor recipients shall be exempted from the tax herein provided for.
(b) For purposes of this section:
(1) "Congressional Medal of Honor recipient" means a person who shows, by satisfactory proof, that he or she is a Congressional Medal of Honor recipient.
(2) "Disabled veteran" means any person who, as a result of injury or disease suffered while on active service with the armed forces of the United States, suffers any of the following:
(A) A disability which has been rated at 100 per cent by the Department of Veteran Affairs or the military service from which the veteran was discharged, due to a diagnosed disease or disorder which substantially impairs or interferes with mobility;
(B) Is so severely disabled as to be unable to move without the aid of an assistant device;
(C) Has lost, or has lost the use of, one or more limbs; or
(D) Has suffered permanent blindness.
(3) "Prisoner of war" means a person who shows, by satisfactory proof, his or her former status as a prisoner of war.
(4) "Qualified member of the Hawaii National Guard shall mean those members of the Hawaii National Guard who are:
(A) Federalized by a call to active duty through an order issued by the President of the United States; and
(B) Serving or has served in the central command area of operations."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2007.
