A BILL FOR AN ACT
RELATING TO PUBLIC HEALTH AND SAFETY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§711- Endangering public health and safety by using body-gripping traps. (a) Notwithstanding section 183D-6, it shall be unlawful to use, set, place, maintain, or tend, or cause to be used, set, placed, maintained, or tended any body-gripping trap.
(b) For purposes of this section, the term "body-gripping trap" includes, but is not limited to, steel-jawed leghold traps, padded jaw leghold traps, conibear traps, and snares, the last of which are commonly referred to as cable restraints.
(c) Subsection (a) does not apply:
(1) To federal, state, or county, departments of health when protecting human health and safety; or
(2) To the use of traps for rodent control for the purpose of controlling wild or domestic rodents.
(d) An offense under this section is a misdemeanor."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
