A BILL FOR AN ACT


 

 

relating to gasoline.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that gasoline that meets the ethanol content requirement set forth in section 486J-10, Hawaii Revised Statutes, is damaging to the non-metal parts of the fuel storage and engine systems in marine engines, general aviation engines, and other small gasoline-driven tools.

     The purpose of this Act is to require refiners to make available gasoline that does not contain ethanol for users of marine equipment, general aviation equipment, and small tool users.

     SECTION 2.  Chapter 486H, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§486H-    Provision of gasoline not containing ethanol.  (a)  Each refiner, as that term is defined in section 486J-1, shall make available to marine fueling stations and its company-operated stations that are owned and operated by the refiner gasoline that does not contain the ethanol content required by section 486J-10.

(b)  Each refiner, as that term is defined in section 486J-1, shall make available to general aviation fueling stations and its company-operated stations that are owned and operated by the refiner gasoline that does not contain the ethanol content required by section 486J-10.

(c)  Each refiner, as that term is defined in section 486J-1, shall make available to its company-operated stations that are owned and operated by the refiner gasoline that does not contain the ethanol content required by section 486J-10 for use by small tool users."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2008.
