A BILL FOR AN ACT
relating to smoking.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 328J, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:
"§328J‑ Disposal of smoking waste. (a) No person shall dispose of any cigarette, cigar, or tobacco product, or any part thereof, in any place where smoking is prohibited under this chapter, except in a designated waste disposal container.
(b) Any person who violates this section shall be fined not more than $300.
§328J‑ Public beaches. Smoking shall be prohibited on public beaches."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on January 1, 2050.
