A BILL FOR AN ACT


 

 

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to allow police officers from the four county police departments to receive a maximum retirement allowance that shall not exceed one hundred per cent of their average final compensation.

     SECTION 2.  Section 88-160, Hawaii Revised Statutes, is amended to read as follows:

     "§88-160  Service retirement benefits.  (a)  Any member of the police force, fire department, or band who has been in the service of any county as a member of the police force, fire department, or band for twenty years and less than twenty-five years, upon the member's written application to the board of trustees to be retired, shall be retired from the police force, fire department, or band, and the member shall thereafter receive from the pension system a monthly payment equal to forty per cent of the average monthly compensation for the five years of the member's service, as hereinafter defined, immediately preceding the date of the member's retirement.

     (b)  Any member of the police force, fire department, or band who has been in the service of the county as a member of the police force, fire department, or band for twenty-five years, upon the member's written application to the board to be retired, shall be retired from the police force, fire department, or band and the member shall thereafter receive from the pension system a monthly payment equal to fifty per cent of the average monthly compensation for the five years of the member's service, as hereinafter defined, immediately preceding the date of the member's retirement.

     (c)  Any member of the [police force,] fire department[,] or band who has been in the service of the county as a member of the [police force,] fire department or band for more than twenty-five years, upon the member's written application to the board to be retired, shall be retired from the [police force,] fire department[,] or band and the member shall thereafter receive from the pension system a monthly payment equal to fifty per cent of the average monthly compensation for the five years of the member's service, as hereinafter defined, immediately preceding the date of the member's retirement, plus two per cent for each year in excess of twenty-five years, but not in excess of eighty per cent.

     (d)  Any member of the police force who has been in the service of the county as a member of the police force for more than twenty-five years, upon the member's written application to the board to be retired, shall be retired from the police force and the member shall thereafter receive from the pension system a monthly payment equal to fifty per cent of the average monthly compensation for the five years of the member's service, as hereinafter defined, immediately preceding the date of the member's retirement, plus three per cent for each year in excess of twenty-five years, but not in excess of one hundred per cent."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2007.
