A BILL FOR AN ACT
relating to state historic division.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 6E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§6E-A Hawaii historic preservation division crisis special fund. (a) There is established the Hawaii historic preservation division crisis special fund into which shall be deposited the following moneys:
(1) Appropriations by the legislature to the special fund; and
(2) Gifts, donations, and grants from public agencies and private persons.
All interest earned or accrued on moneys deposited in the fund shall become part of the fund. The fund shall be administered by the Department of Land and Natural Resources; provided that the department may contract with a public or private agency to provide day-to-day management of the fund.
(b) The department may expend moneys from the fund to purchase those historic places, lands, buildings, or other items that are deemed by the Historic Preservation Board to be in extreme crisis and in danger of losing forever.
(c) The department shall adopt rules in accordance with Chapter 91 for the purposes of this section."
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $_____________, or so much thereof as may be necessary for fiscal year 2007-2008, for funding the Hawaii Historic Preservation Crisis Special Fund.
The sum appropriated shall be expended by the Department of Land and Natural Resources for the purposes of this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2007.
