A BILL FOR AN ACT

RELATING TO EDUCATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

     SECTION 1.  The purpose of this measure is to combat the growing problem of childhood obesity in Hawaii's children and youth.

     SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-  Physical education requirement; high school. All high school students, grades 9 through 12 shall participate in a physical education class every year while in high school; provided that the class is offered on a "pass-fail" basis.

The department of education may adopt rules pursuant to chapter 91 to effectuate this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
