A BILL FOR AN ACT
relating to physician assistants.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§453- Physician assistant; disaster medical care. (a) Any physician assistant who is licensed in this State or licensed or authorized to practice in any other United States jurisdiction may render aid or medical care or otherwise assist in providing medical care in disaster or emergency conditions when a supervising physician is not present.
(b) Any physician who is licensed in this State may supervise a licensed physician assistant in providing disaster or emergency medical care, without regard to the degree of supervision required of the supervising physician in section 453-5.3.
(c) A licensed physician assistant who provides any aid, medical care, or other assistance in good faith during a disaster or emergency condition shall not be liable for any civil damages resulting from the physician assistant's acts or omissions, except for such damages as may result from the physician assistant's gross negligence or wanton acts or omissions.
(d) The board of medical examiners may adopt rules under chapter 91 to implement this section."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
