A BILL FOR AN ACT


 

 

RELATING TO SALES TRANSACTIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 481B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§481B-    No person who is engaged in the business of selling or offering for sale goods, property, or merchandise shall charge a consumer a different price depending upon whether the consumer makes the purchase in cash or through the use of a credit or debit card without first disclosing to the consumer:

     (1)  The fact that different prices are charged depending upon whether the purchase is made in cash or through the use of a credit or debit card; and

     (2)  The actual difference in the prices charged."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
