A BILL FOR AN ACT
RELATING TO THE PROCUREMENT CODE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that copper wire theft is an increasing problem statewide and nationwide as well. These crimes are costly and inconvenient. Though penalties may be increased and investigations commenced, the legislature finds that an even-handed approach to deter these criminal activities may be preferable. The purpose of this Act is to deter theft of copper wire by setting a preference in the public procurement code for stamped wiring.
SECTION 2. Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to part X to be appropriately designated and to read as follows:
"§103D- Copper wiring. In any expenditure of public funds to procure copper wiring, where the price of the copper wiring exceeds fifty cents per foot, a preference shall be given for purposes of bid evaluation to a bid that:
(1) Specifies copper wiring that has been stamped for identification; and
(2) Is among the lowest three bids submitted."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
