A BILL FOR AN ACT


 

 

relating to emergency preparedness.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding three new sections to be appropriately designated and to read as follows:

     "§46-A  Supply of potable water.  To preserve the continuous availability of potable water to the major population areas of each county, each county shall provide emergency backup generators, or the equivalent, to the county agency responsible for maintaining the county's water supply.

     §46-B  Natural disasters; building design and construction; hospitals.  Each county shall incorporate into its building code by July 1, 2008, standards to ensure that all hospitals within the county are able to withstand:

     (1)  Category four hurricanes; and

     (2)  Earthquakes of a magnitude up to 8.0 on the Richter            scale.

     The building standards shall apply to all new and renovated hospitals, including state hospitals.

     §46-C  Natural disasters; building design and construction; hurricane shelters.  Each county shall incorporate into its building code by July 1, 2008, standards to ensure that all designated hurricane shelters within the county are able to withstand:

     (1)  Category four hurricanes; and

     (2)  Earthquakes of a magnitude up to 8.0 on the Richter            scale.

     The building standards shall apply to all new and renovated buildings that are or will be designated as hurricane shelters, including state buildings."

     SECTION 2.  The department of defense shall establish a statewide public emergency notification system.

     SECTION 3.  The department of defense shall establish an emergency communication system that:

     (1)  Establishes common communication links for all first responders on each island of the state, with inter-island capability for major disasters; and

     (2)  Provides for the integration of all first responders into a common response plan, including professional and volunteer units.

     SECTION 4.  The department of health shall:

     (1)  Establish a volunteer emergency response network, including a community emergency response team;

     (2)  Provide emergency medical technician training, or its equivalent, to any resident who requests it; and

     (3)  Encourage individuals who are professional first responders to become involved with professional or volunteer groups that deal with emergency preparedness.

     SECTION 5.  The department of health shall establish protocols and conduct regular mandatory inspections to ensure the constant availability of electricity and potable water in hospitals.

     SECTION 6.  The department of defense, in cooperation with the civil defense agency of each county, shall provide training for members of community emergency response teams, including:

     (1)  Providing first-aid supplies and equipment for each trained volunteer; and

     (2)  Providing emergency tents, toilets, and storage for each county within each county.

     SECTION 7.  There is appropriated out of the general revenues of the State of Hawaii the sum of $      or so much thereof as may be necessary for fiscal year 2007-2008 for grants-in-aid to finance the provision of emergency backup generators, or the equivalent, to the county agency responsible for maintaining the county's water supply, as required by section 46-A, Hawaii Revised Statutes, shall be distributed in the following manner:

          City and County of Honolulu       $

          County of Hawaii                  $

          County of Maui                    $

          County of Kauai                   $

          The grants-in-aid to each county shall be made after each county and the department of defense have agreed upon the details of the emergency backup generators, or the equivalent.

     SECTION 8.  There is appropriated out of the general revenues of the State of Hawaii the sum of $       or so much thereof as may be necessary for fiscal year 2007-2008 and the same sum or so much thereof as may be necessary for fiscal year 2008-2009 for the purposes described in sections 2, 3, and 6 of this Act.

     The sums appropriated shall be expended by the department of defense for the purposes of this Act.

     SECTION 9.  There is appropriated out of the general revenues of the State of Hawaii the sum of $       or so much thereof as may be necessary for fiscal year 2007-2008 and the same sum or so much thereof as may be necessary for fiscal year 2008-2009 for the purposes described in sections 4 and 5 of this Act.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 10.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 11.  New statutory material is underscored.

     SECTION 12.  This Act shall take effect on July 1, 2007.
