A BILL FOR AN ACT


 

 

relating to the landlord-tenant code.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 521-35, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  A rental agreement may provide for the payment by the tenant of the costs of a suit, for unpaid rent, and reasonable attorney's fees not in excess of [twenty-five] fifty per cent of the unpaid rent after default and referral to an attorney not a salaried employee of the landlord or the landlord's assignee."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
