A BILL FOR AN ACT

 

 

relating to scrap metal.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 445, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§445-A  Special requirements for copper.  In addition to the requirements of section 445-233, every scrap dealer, when purchasing copper from an individual, shall require the individual to present valid identification and be fingerprinted by the scrap dealer.  The scrap dealer shall keep at the dealer's place of business a copy of the seller's identification and fingerprints for a period of two years after the date of purchase.  The copy of the identification and fingerprints may be examined at any time by the chief of police or the chief's designee."

     SECTION 2.  Section 445-234, Hawaii Revised Statutes, is amended to read as follows:

     "§445-234  Applicability.  Any person required to be licensed under chapter 289 or under section 445-171 shall not be required to pay an additional fee under section 445-232; provided that such person shall obtain the license required by section 445-232 and shall follow the requirements of sections 445-232 [and], 445-233, and 445-A when acting as a scrap dealer."

     SECTION 3.  Section 445-235, Hawaii Revised Statutes, is amended to read as follows:

     "§445-235  Prohibitions; penalty.  Any person who violates sections 445-232 and 445-233[,] or section 445-A, or any person who falsifies a statement required by section 445-233[,] or falsifies the identification required by section 445-A shall be guilty of a misdemeanor."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
