RELATING TO ENDANGERING THE WELFARE OF A MINOR.

Expands the crimes of endangering the welfare of a minor in the first and second degrees to include situations in which an adult causes or permits a minor to inject, ingest, or inhale a controlled substance that was not prescribed by a physician. (HB1406 HD1)

RELATING TO PEDESTRIANS' RIGHT OF WAY.

Clarifies a driver's duty to stop for a pedestrian in a crosswalk.  Imposes fines for drivers and pedestrians who fail to comply with the crosswalk law based on the number of previous infractions of the same offense.  (SD1)

RELATING TO DRIVER LICENSING.

Specifies that proof that a defendant possessed an out-of-state driver's license is an affirmative defense to the charge of driving without a license, that must be proved by the defendant.  Repeals statutory cross-reference to an exemption to relieve the burden of proof on prosecutors.  (SD1)

Allows for the establishment of traffic emergency zones to provide highway access to designated areas.  (SD1)

RELATING TO TRANSPORTATION.

Increases fines for certain violations of vehicle length and gross weight requirements.  Repeals fines for second, third, and subsequent violations.  Requires, rather than permits, the department of transportation to establish a process for vehicle weight violators to mail in uncontested fine payments.  (SD1)

RELATING TO THE PERFECTION OF APPEALS TO THE TAX APPEAL COURT.

Clarifies that an appeal by a taxpayer to the tax appeal court from a board of review decision, or the decision of an equivalent county administrative body, must be served on the director of taxation or real property assessment division of the county within thirty days of the date of the final assessment to properly confer jurisdiction over the appeal.  (SD1)

·         In person: 30 copies of their testimony to the committee clerk, Room 227, State Capitol.

 

·         By fax:  Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing.  When faxing, please indicate to which committee the testimony is being submitted, the date and time of the hearing, and the number of copies needed for submittal.

 

·         By Email:  Testimony may be emailed if less than 5 pages in length, to the Legislature's Public Access Room at testimony@capitol.hawaii.gov.  Please indicate to which committee the testimony is being submitted, the date and time of the hearing, and the number of copies needed for submittal.  In addition, please provide the testifier's name and mailing address in the email.  Email sent to individual offices or any other Senate office will not be accepted.

 

If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign language interpreter or wheelchair accessibility), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.

 

Public Folder.  A folder labeled “Public Folder” containing the measures and testimonies for the hearing will be available for shared use by members of the public.
