RELATING TO BAIL. Creates a licensing requirement for bail bonding agents. Requires the director of commerce and consumer affairs to adopt rules for the process and procedure of obtaining a bail bonding agent license. Prohibits certain acts by bail bonding agents. Provides for civil and criminal penalties for violations by bail bonding agents. Creates registration requirements with the attorney general for bail fugitive recovery persons. Requires the director of commerce and consumer affairs to adopt rules regulating compensated sureties.

RELATING TO CRIMINAL TRESPASS. Repeals the offense of criminal trespass in the second degree that prohibits persons from entering or remaining unlawfully on public property for a specified time period.

RELATING TO LABOR. Amending Sections 89-9(d) by clarifying that certain statutory actions shall not be used to invalidate collective bargaining agreements in effect on and after June 30, 2007 and such actions may be included in collective bargaining agreements.

RELATING TO EMPLOYMENT. Amends definitions of "closing", "covered establishment", and "employer". Requires employer to notify employees of divestiture. Imposes penalties for failure to notify employees of business closing.

RELATING TO FIREARMS. Permits owner of a pistol to use any ammunition magazine authorized for use with the pistol by the manufacturer of the pistol. Repeals the prohibition on magazines with a capacity in excess of ten rounds.

RELATING TO OFFENSES AGAINST THE PERSON. Adds violence against emergency medical services personnel to the offenses of assault in the second degree and terroristic threatening in the first degree.

RELATING TO CRIMINAL PROCEDURE. Eliminates requirement that arrest citations contain an offender's full social security number. Authorizes verification of arrest citation and traffic crime complaint by declaration in accordance with rules of court.

RELATING TO LIMITING CIVIL LIABILITY. Limits the civil liability of property owners to persons injured or killed on premises while committing a class A or B felony or certain violent crimes.

RELATING TO JURORS AND PROSPECTIVE JURORS. Updates and clarifies definitions. Streamlines and affords greater flexibility to the courts to determine the most efficient and effective procedures for selecting, qualifying, summoning, managing, and compensating prospective jurors and jurors. Repeals obsolete provisions.

RELATING TO GRAND JURIES. Shortens the period grand juries and grand jury counsel must serve from 1 year to 6 months. Requires grand jury counsel to be present at grand jury proceedings. Requires grand jury counsel to advise the grand jury whenever the counsel determines it to be appropriate.

SB 1339 |
RELATING TO THE HAWAII RULES OF EVIDENCE. Allows individuals, corporations, and government entities to offer apologies or other expressions of sympathy without fear of such gestures being used against them to establish civil liability.

· By fax: Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to which committee the testimony is being submitted, the date and time of the hearing, and the number of copies needed for submittal.

· of the hearing, and the number of copies needed for submittal. In addition, please provide the testifier's name and mailing address in the email.
If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign language interpreter or wheelchair accessibility), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
