SENATE RESOLUTION

 

 

URGING THE OFFICE OF HAWAIIAN AFFAIRS TO CONTINUE TO CONVENE A TEMPORARY COMMISSION ON BIOPROSPECTING.

 

 

 


WHEREAS, the Twenty-third Legislature in 2006 adopted House Concurrent Resolution No. 193, House Draft 1, requesting the Governor to establish a temporary advisory commission on bioprospecting, to be placed within the Office of Hawaiian Affairs for administrative purposes only, to make recommendations for policy development in the areas of:

 

     (1)  Prior informed consent;

 

     (2)  Equitable benefit-sharing;

 

     (3)  Bio-safety protocols;

 

     (4)  A permitting and licensing process; and

 

     (5)  Cultural rights for the use of Hawaii's biodiversity; and

 

WHEREAS, House Concurrent Resolution No. 193, House Draft 1, requested that the commission prepare a report of its recommendations for submission to the Legislature and the Governor not later than twenty days prior to the convening of the Regular Session of 2007; and

 

WHEREAS, on January 3, 2007, the Office of the Governor finalized and notified the Office of Hawaiian Affairs of the gubernatorial appointments to the commission; and

 

WHEREAS, the Office of Hawaiian Affairs has started the process of convening the commission, but additional time will be needed for the commission to start up and to complete its work in addressing House Concurrent Resolution No. 193, House Draft 1; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, that the Office of Hawaiian Affairs is urged to continue to convene the Temporary Commission on Bioprospecting initially requested through House Concurrent Resolution No. 193, House Draft 1 (2006); and

 

BE IT FURTHER RESOLVED that the commission is requested to prepare a report of its recommendations to the Legislature and the Governor not later than twenty days prior to the convening of the Regular Session of 2008; and

 

BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Governor, the President of the Senate, the Speaker of the House of Representatives, and the Chairperson of the Board of Trustees of the Office of Hawaiian Affairs.
