THE SENATE

S.B. NO.

989

TWENTY-FOURTH LEGISLATURE, 2007

STATE OF HAWAII

A BILL FOR AN ACT

relating to gasoline dealers.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1.  For decades, published gasoline prices always contained a fraction of a cent.  Years ago, when gasoline was twenty cents a gallon, this fraction of a cent made some marketing sense.  Today, with gasoline prices hovering at times near $3 per gallon, adding a fraction of a cent to the price makes no sense, but remains a marketing anachronism.

The purpose of this Act is to prohibit the marketing of gasoline with prices containing a fraction of a cent.

SECTION 2.  Chapter 486H, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§486H-    Gasoline pricing.  No gasoline dealer shall set the retail price of gasoline with a price containing a fraction of a cent."

SECTION 3.  New statutory material is underscored.

SECTION 4.  This Act shall take effect July 1, 2007.
