A BILL FOR AN ACT

 

 

relating to the procurement code.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 103D, Hawaii Revised Statutes, is amended by adding a new section to part X to be appropriately designated and to read as follows:

     "§103D-    Repair and maintenance; experiential learning opportunities; public school facilities.  (a)  All qualified bids submitted for repair and maintenance services on the premise of any public school facility shall receive a ten per cent preference for purposes of bid evaluation, if the repair and maintenance service bids will provide the students of the public school facilities experiential learning opportunities.

     (b)  Bidders shall meet qualification criteria established by the state procurement office with the cooperation and assistance of the department of education and the University of Hawaii.

     (c)  A proposed experiential learning opportunity and its estimated cost to the bidder may be included in the bid.  The amount of procurement preference shall be no more than one hundred per cent of the estimated cost of the proposed learning opportunity to the bidder.

     (d)  A claim for a procurement preference under this section shall be at the qualified bidder's discretion.

     (e)  The policy board shall adopt rules in accordance with chapter 91 to implement this section.

     (f)  For purposes of this section:

     "Experiential learning opportunity" means any learning opportunity that allows the learner to attain information and practical skills that are necessary to perform in the workplace and provides significant experiences with real outcomes that create measurable learning achievements through participation and reflection.

     "Repair and maintenance" means the repair, replacement, or maintenance of the exterior or interior, including the fixtures, furnishings, and equipment of any state public education facility that is required:

     (1)  For the facility to be used for the next twenty-five years;

     (2)  For health or safety reasons;

     (3)  To comply with legal mandates;

     (4)  To comply with current building codes; or

     (5)  For preventive maintenance reasons."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
