A BILL FOR AN ACT
relating to the state of hawaii.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 1-1, Hawaii Revised Statutes, is amended to read as follows:
"§1-1 Common law of the State;
exceptions. The common law of England, as ascertained by English and
American decisions, is declared to be the common law of the State of Hawaii in all cases, except as otherwise expressly provided by [the]:
(1)
The Constitution or laws of the United States[, or by the];
(2) The laws of the State[, or
fixed by];
(3) Hawaiian judicial precedent[, or
established by]; or
(4) Hawaiian usage;
provided that no person shall be subject to criminal proceedings except as provided by the written laws of the United States or of the State."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
