A BILL FOR AN ACT

 

 

Relating to campaign contributions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


          SECTION 1.  Section 11-91, Hawaii Revised Statutes, is amended by amending the definition of "matching payment period" to read as follows:

     "Matching payment period" means:

     (1)  For a primary election, from January [1] 22 of the year of a general election through the day of the primary election, or nine months prior to a special election through the day of a special election; and

     (2)  For a general election, from January [1] 22 of the year of a general election through the day of the general election.

SECTION 2.  Section 11-191, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

     "Funding period" means:

     (1)  For a regular election, the period from January 22 of the year of the regular election through the sixtieth day after the day of the regular election;

     (2)  For a primary election, the period from January 22 of the year of the primary election through the sixtieth day after the day of the primary election; and

     (3)  For a special election, the period beginning nine months prior to the special election through the sixtieth day after the day of the special election."

     SECTION 3.  Sections 11-194, 11-204, 11-205.6, 11-212, 11-213 and 11-221 are amended by substituting the words "funding period" wherever the words "election period" appear, as the context requires.

     SECTION 4.  Chapter 11, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§11-    Campaign contributions; session limitations.  (a)  No candidate or their candidate's committees shall accept, solicit, or receive contributions during the period when the legislature is convened in session.  For purposes of this section, the legislature is convened in session at any time from the opening day of the special or regular session and continued through the day of adjournment sine die for that session.

     §11-    Nomination papers; contributions.  (a)  Each candidate shall file nomination papers with the chief election officer or county clerk within ten days of the date the candidate, the candidate's committee, or any other committee associated with or coordinated by the candidate, makes contributions that amount to more than $100 in the aggregate; provided that nomination papers are made available pursuant to section 12-2.5."

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect upon its approval
