A BILL FOR AN ACT
relating to invasive species.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 150A, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:
"§150A-A Inspection and quarantine treatment service charge. (a) The department shall prescribe a schedule of service fees and charges and collect the fees or charges for invasive species pest inspection and quarantine treatment services from any person who imports any article or packing material described in section 150A-5. The department shall ensure that the fees and charges are commensurate with the costs of the inspection and quarantine treatment.
(b) If a person subject to the service fees or charges under this section fails to pay the service fee or charge when due, the department shall assess a late payment penalty.
(c) The service fees, charges, or penalties collected by the department under this section shall be deposited into the pest inspection and quarantine treatment services fund under section 150A-B.
§150A-B Pest inspection and quarantine treatment services fund. (a) There is established in the state treasury the pest inspection and quarantine services fund, into which shall be deposited:
(1) Legislative appropriations for inspection and quarantine treatment services;
(2) Service fees and charges collected under section 150A‑A; and
(3) Federal funds received for pest inspection and quarantine services programs.
(b) The moneys in the pest inspection and quarantine services fund shall be used by the department for the operation of inspection and monitoring programs and related facilities and the execution of emergency remedial measures when pests are detected in the course of inspection and quarantine treatment services by the department."
SECTION 2. In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2020.
