HOUSE RESOLUTION

 

 

REQUESTING THE COUNTY POLICE DEPARTMENTS TO VIGOROUSLY ENFORCE LAWS RELATING TO THE OPERATION OF MOPEDS.

 

 

 


     WHEREAS, there is a proliferation of the presence and operation of mopeds in residential neighborhoods; and

 

     WHEREAS, many of these mopeds are operated by minors for recreational purposes; and

 

     WHEREAS, in many instances these mopeds are not being operated in a safe manner; and

 

     WHEREAS, the operation of mopeds in residential neighborhoods has led to increases in noise pollution, disturbing the quiet of residential neighborhoods; and

 

     WHEREAS, section 291-24, Hawaii Revised Statutes, requires any moped being operated on a public highway to be equipped with a muffler in constant operation to prevent any excessive or unusual noise and further prohibits the modification of the moped exhaust system in any manner that will amplify or increase the noise emitted by the motor of the moped; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, that the police departments of the respective counties are requested to vigorously enforce the provisions of section 291-24, Hawaii Revised Statutes, requiring the equipping and operation of mufflers on mopeds and the prevention of the modification of any muffler that will amplify or increase the noise emitted by the moped motor; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chief of Police of the City and County of Honolulu, the County of Kauai, the County of Maui, and the County of Hawaii.
