HOUSE RESOLUTION

 

 

URGING THE owners OF THE TURTLE BAY RESORT TO STOP FURTHER DEVELOPMENT PENDING the preparation and acceptance of a supplemental statement TO ITS ENVIRONMENTAL IMPACT STATEMENT.

 

 

 


     WHEREAS, over twenty years ago, in 1986, the City and County of Honolulu issued a special management area for the expansion of what was known at the time as the Kuilima Resort and now called the Turtle Bay Resort on the north shore of Oahu; and

 

     WHEREAS, the expansion plans call for the development of up to five additional hotels at the resort, adding thousands of additional units to the rural north shore district; and

 

     WHEREAS, the special management area permit was issued partially based upon an environmental impact statement accepted in 1985, twenty-two years ago; and

 

     WHEREAS, while the expansion plans have not been implemented to date, the new owner, Kuilima Resort Company, a subsidiary of Oaktree Capital Management, LLC, of the Turtle Bay Resort is proceeding with plans to commence the expansion plans; and

 

     WHEREAS, this passage of time has resulted in significant changes in the environment of the north shore and the expansion now planned could result in impacts that were not considered twenty-two years ago; and

 

     WHEREAS, section 11-200-26, Hawaii Administrative Rules (Department of Health), requires that, when the timing of a project significantly changes, the environmental impact statement must be supplemented; and

 

     WHEREAS, no supplemental statement has been prepared, submitted for agency review, or accepted by the proper agency; and

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, that the present owner of the Turtle Bay Resort, Kuilima Resort Company, is urged to refrain from any further development at the Turtle Bay Resort until a supplemental statement to the original environmental impact statement is prepared, reviewed, and accepted; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of Health, Director of Environmental Quality Control, Chair of the Honolulu City Council, and Kuilima Resort Company.
